These Terms of Service ("Terms") govern your use of aerialtitans.com (the "Site") and your purchase of equipment, parts, and attachments from Aerial Titans, Inc. ("Aerial Titans," "we," "us"), a Georgia corporation. By using the Site or placing an order, you agree to these Terms, our Shipping Policy, our Refund Policy, and our Privacy Policy, which are incorporated by reference. If you are ordering on behalf of a company, you represent that you have authority to bind it.
Who May Purchase
Our products are industrial equipment intended for commercial use by trained operators. You must be at least 18 years old and able to form a binding contract to purchase. By purchasing, you confirm the equipment will be operated only by persons trained and authorized in accordance with applicable law.
Listings, Photos, and Specifications
Used-equipment listings show photographs of the actual unit offered, identified by serial number. Hour-meter readings, condition notes, and specifications are accurate to the best of our knowledge as of the listing date; hours may increase modestly before delivery due to inspection, load testing, and yard movement. Manufacturer specifications (platform height, capacity, weight, dimensions) are provided from manufacturer data and may vary by configuration. If a detail matters to your application, confirm it with us before purchase - we will gladly verify anything on the machine itself.
Pricing and Errors
All prices are in US dollars and exclude taxes, freight, titling, and registration unless stated otherwise. We work hard to keep listings accurate, but occasionally a price, photo, or specification is published in error. We reserve the right to correct errors, update prices, and cancel any order arising from an error, in which case you receive a prompt, full refund. A unit remains available for sale until payment or an agreed deposit is received; listing a unit is an invitation to purchase, not a reservation.
Orders, Payment, and Taxes
Accepted payment methods are shown at checkout; equipment purchases may also be completed by wire transfer or ACH by arrangement. Orders ship or release for pickup after payment has cleared. Sales tax is collected where required; buyers claiming an exemption must provide a valid exemption certificate before the sale is finalized.
All amounts due are payable in full upon receipt of invoice. Late payments accrue interest at the lesser of 2% per month (24% per annum) or the maximum rate permitted by law. Customer agrees to pay all costs incurred by Aerial Titans to enforce these Terms, including collection costs, attorneys’ fees, and mediation/arbitration costs.
Financing
Financing offered through the Site is provided by independent third-party lenders, not by Aerial Titans. Credit decisions, rates, and terms are the lender's alone, and your financing agreement is with the lender. "Apply for financing" tools on the Site transmit your application to the finance provider under that provider's terms and privacy policy. Approval is not guaranteed, and a financing application does not reserve a unit.
Title, Security Interest, and Risk of Loss
Title to equipment passes upon payment in full. Until payment in full, Aerial Titans retains title to, and a purchase-money security interest in, the equipment and may file financing statements to protect it. Customer grants Aerial Titans all rights and remedies available under Article 9 of the Uniform Commercial Code. Customer agrees to pay all costs incurred in repossession and disposition of equipment, including attorneys’ fees.
Risk of loss passes:
- At pickup: upon Customer’s acceptance at the Store Location.
- At delivery by Aerial Titans: upon delivery to Customer’s designated location.
- At delivery by Carrier: upon delivery of equipment to Carrier.
Customer bears all risk and liability in transport, including compliance with manufacturer specifications and roadworthiness.
Safety, Use, and Maintenance
Aerial work platforms and telehandlers are dangerous when misused. You are solely responsible for operator training and certification in accordance with OSHA regulations and ANSI/SAIA A92 standards; daily inspections and maintenance after delivery; use of appropriate personal protective equipment; and compliance with all laws applicable at your worksite.
Customer must contact the manufacturer for documentation regarding use and maintenance and ensure equipment meets manufacturer specifications and regulatory requirements before placing into service.
Warranties and Disclaimers
New equipment carries the manufacturer’s warranty. Used equipment is sold “AS IS, WITH ALL FAULTS” unless otherwise indicated on the invoice. Aerial Titans passes through manufacturer warranties for new equipment to the extent permitted. Except as expressly stated on your invoice or in our Refund Policy, all equipment, parts, and services are provided without warranty of any kind. Aerial Titans disclaims all implied warranties, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.
No employee or agent is authorized to modify these Terms orally.
Limitation of Liability
To the maximum extent permitted by law, Aerial Titans’ total liability arising from any order or use of the Site is limited to the amount you paid for the product giving rise to the claim. Aerial Titans is not liable for indirect, incidental, special, or consequential damages, including lost profits, rental costs, or jobsite delays. Some jurisdictions limit such exclusions; in those jurisdictions our liability is limited to the fullest extent permitted.
Indemnification / Hold Harmless
Customer agrees to indemnify, defend, and hold harmless Aerial Titans, its officers, agents, employees, affiliates, parents, and subsidiaries from any and all liability, claims, loss, damage, or costs (including attorneys’ fees, loss of profit, business interruption, property damage, bodily injury, or wrongful death) arising out of or related to the operation, use, possession, purchase, or sale of equipment. This includes strict or product liability claims. Customer is not obligated to indemnify Aerial Titans for losses caused solely by Aerial Titans’ intentional misconduct or sole negligence.
Site Content and Intellectual Property
Site content - photographs, descriptions, logos, and design - belongs to Aerial Titans or its licensors and may not be copied for commercial use without permission. Manufacturer names and logos are trademarks of their respective owners, used to identify the equipment we sell; their appearance does not imply sponsorship of this Site.
Governing Law, Venue, and Disputes
These Terms shall be governed by the laws of the State of Georgia, without regard to its choice of law rules. Exclusive jurisdiction lies in Georgia courts, and venue objections are waived. Trial by jury is waived to the fullest extent permitted by law.
Alternative Dispute Resolution
Any dispute under these Terms shall first be attempted to be settled through mediation with Bay Mediation & Arbitration. If mediation fails, litigation may proceed subject to the above jurisdiction and venue provisions. The failure to commence mediation within sixty (60) days of demand thereof, shall be sufficient grounds for either party to file litigation.
Export Compliance
Customer acknowledges that equipment is subject to U.S. export and sanctions laws and regulations, including the Export Administration Regulations and sanctions programs. Customer agrees to comply with all applicable prohibitions and licensing requirements.
Changes to These Terms
We may update these Terms from time to time. The version posted at the time of your order governs that order.
Entire Agreement
This Policy is incorporated into and forms part of the Agreement. Together, they constitute the entire understanding between Company and Customer regarding purchases made through the Site. In the event of any conflict between this Policy and the Agreement, the Agreement shall supersede and control. No oral modifications are permitted.
