Introduction

This Shipping Policy ("Policy") is issued by Aerial Titans, Inc. ("Company") and governs the shipment and delivery of equipment, parts, and attachments purchased by customers ("Customer"). This Policy is intended to be read in conjunction with the Aerial Titans Inc. Sales Agreement ("Agreement"). Capitalized terms not defined herein shall have the meanings assigned in the Agreement.

For purposes of this Policy:

  • "Company" means Aerial Titans, Inc.
  • "Customer" means the purchaser of equipment, parts, or attachments from Company.
  • "Sales Agreement" means the Aerial Titans Inc. Sales Agreement referenced herein.
  • "Policy" means this Shipping Policy issued by Company.

Equipment Freight

Aerial equipment ships by flatbed, hotshot, or Less Than Truckload (LTL) freight depending on the machine. Freight charges are quoted per order based on the unit and Customer’s delivery ZIP code. Any shipping estimate displayed at checkout is based on a commercial address with equipment-receiving capability. Company will confirm the final freight cost prior to dispatch. Customer may cancel the order without charge if the confirmed freight cost is not acceptable.

Freight delivery is curbside/dock delivery. Customer is responsible for offloading. Self-propelled units in operating condition may be driven off a flatbed or ramp trailer; otherwise, Customer must arrange for a dock, forklift of adequate capacity, or ramps. Customer must disclose site constraints (e.g., residential street, jobsite restrictions, gate hours, lack of dock) at the time of order. Carrier will schedule a delivery appointment with the phone number provided by Customer. Missed appointments and driver detention beyond two (2) hours of free time are billed at the carrier’s rate.

Dispatch and Transit Times

In-stock units are typically prepared and released to the carrier within seven (7) to ten (10) business days of cleared payment. Transit times vary depending on distance and carrier availability, commonly one (1) to seven (7) business days after dispatch within the continental United States. Timelines are estimates only and not guarantees. Company will provide carrier and tracking details at dispatch.

Customer Pickup

Customer may pick up equipment by appointment at Company’s Cartersville, GA (39 Curtis Court SW, Cartersville, GA 30120) or Archbold, OH (V-692 State Route 66, Archbold, OH 43502) locations. Company will load Customer’s truck or trailer at no charge, provided the equipment is rated for the machine’s weight. Company will not load vehicles or trailers that are visibly over capacity. Units must be picked up within fourteen (14) days of purchase; storage beyond that period incurs a yard fee of one hundred dollars ($100.00) per day.

Parts and Attachments

Parts orders ship via UPS or FedEx Ground from the nearest stocking location, typically within one (1) to two (2) business days. Oversized attachments ship LTL freight, quoted per order. Expedited shipping is available at Customer’s cost. Same-day dispatch of in-stock parts requires Customer to call before 2:00 PM Eastern.

Receiving Shipments

Customer must inspect all shipments upon delivery before signing the carrier’s receipt. Customer shall:

  • Walk around the machine and compare its condition to listing photographs.
  • Note any damage, however minor, in writing on the delivery receipt/bill of lading before signing. Writing "Subject to inspection" is insufficient.
  • Photograph the unit on the trailer if any discrepancy is observed.
  • Report damage to Company within forty-eight (48) hours with photographs.

If damage is documented at delivery, Company will manage the freight claim and ensure Customer is made whole. A clean signature releases the carrier from liability and limits recovery.

Title and Risk of Loss

For shipped orders, risk of loss passes to Customer when the unit is loaded onto the carrier at Company’s facility (FOB origin), consistent with the Agreement. Title passes upon payment in full. For customer pickup, risk of loss passes when the unit is loaded onto Customer’s truck or trailer.

Service Area

Company ships to the forty-eight (48) contiguous states. Shipments to Alaska, Hawaii, and export shipments are available on a quoted basis to Customer’s freight forwarder at a U.S. port. The forwarder is responsible for export documentation and international carriage.

Governing Law and Venue

This Policy shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. Any disputes arising under this Policy shall be subject to the jurisdiction and venue provisions set forth in the Agreement.

Alternative Dispute Resolution

Any dispute arising under this Policy shall first be submitted to mediation before Bay Mediation & Arbitration (https://bayadr.com/mediation/), in accordance with the Agreement. The failure to commence mediation within sixty (60) days of demand thereof, shall be sufficient grounds for either party to file litigation.

Entire Agreement

This Policy is incorporated into and forms part of the Agreement. Together, they constitute the entire understanding between Company and Customer regarding shipping and delivery. In the event of any conflict between this Policy and the Agreement, the Agreement shall supersede and control. No oral modifications are permitted.
